1. Definitions and Interpretation

In these Terms, the following definitions apply:

• "Platform" or "Website" refers to links.digitaldashmedia.com and all associated services, subdomains, and features operated by DDM.
• "User", "you", or "your" refers to any individual or entity that accesses, registers an account, or uses the Platform.
• "Content" means all text, graphics, images, software, code, links, and other materials generated, displayed, or compiled on the Platform.

2. Account Registration and Security

To access certain features of the Platform, you may be required to register for an account. By creating an account, you agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the absolute confidentiality of your account credentials, passwords, and access tokens.
• Accept full responsibility for all activities, actions, and data transmissions that occur under your account.
• Notify DDM immediately at security@digitaldashmedia.com upon becoming aware of any unauthorized use or breach of security.

3. Acceptable Use Policy

You agree to use the Platform strictly for lawful purposes. You are explicitly prohibited from engaging in any activity that:

• Violates any applicable local, national, or international laws or regulations.
• Infringes upon the intellectual property rights, privacy rights, or contractual rights of DDM or any third party.
• Introduces malicious software, viruses, worms, Trojan horses, or any code designed to disrupt, damage, or limit the functionality of our infrastructure.
• Employs automated scrapers, data-mining tools, bots, or reverse-engineering practices on any portion of the Platform's source code or databases.
• Disrupts or interferes with the security, integrity, or proper operation of servers or networks connected to the Platform.

4. Intellectual Property Rights

All intellectual property rights in the architecture, design, layout, graphics, code, software, algorithms, and trade names used on the Platform are owned exclusively by Digital - Media (DDM) or its licensors. Nothing contained within these Terms transfers any title, ownership, or exclusive rights to you. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely in accordance with these Terms.

5. Disclaimers and Limitation of Liability

The Platform and all services are provided on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, DDM, its directors, employees, or agents shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your ability or inability to access or use the Platform.
• Any technical downtime, service interruptions, server failures, or data loss.
• Unauthorized access, alteration, or corruption of your transmissions or account data.

6. Termination of Service

DDM reserves the right, in its sole discretion, without prior notice or liability, to suspend, terminate, or restrict your access to your account or the entire Platform for any reason, including but not limited to a breach or suspected violation of these Terms, non-compliance with security protocols, or operational decommissioning of digital assets.

7. Governing Law and Jurisdiction

These Terms shall be governed by, interpreted, and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles. Any legal action, dispute, or proceeding arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Brisbane, Queensland, Australia.
